LavaChat Terms of Use

1. Relationship with Apple EULA

This Terms of Use ("TOU") supplements the Apple EULA. The Apple EULA governs your license to use the app and contains region‑specific legal terms. If this TOU conflicts with the Apple EULA, the Apple EULA controls.

2. Service Description

LavaChat is a local iOS application (iOS 16+) without our own backend servers. The app enables you to configure and interact with large language models (LLMs). Content is only transmitted when you initiate a request.

3. Third‑party LLMs and API Keys

• You choose which third‑party LLM provider(s) to use. You must review and comply with each provider’s terms and policies.
• Your API keys are provided by you and stored locally in the iOS Keychain. You are responsible for their legality, confidentiality, usage, and any associated fees/quotas.
• When you send prompts or files, they are transmitted via encrypted connections (HTTPS) directly to the provider(s) you configured. Avoid submitting sensitive personal data.
• We do not host, retain, or moderate your prompts or outputs on our own servers.

4. Subscriptions and Billing (StoreKit)

• Subscriptions and payments are processed by Apple via StoreKit. We do not access or store payment card information.
• Auto‑renewal and cancellation are managed in your Apple ID settings. Refunds, if any, follow Apple’s policies.
• Unless otherwise stated in the app, no free trial is offered.

5. Acceptable Use Policy

You may not use the app to upload, generate, or transmit content that is unlawful, infringing, harassing, hateful, discriminatory, sexually explicit, violent, deceptive, malicious (including malware or attempts to circumvent security), or that violates any third‑party policy, export law, or sanction regime. We may suspend or restrict access where we reasonably believe misuse or violation occurs.

6. AI Output Disclaimer

LLM outputs may be inaccurate or incomplete and are provided for informational purposes only. They do not constitute professional advice (including legal, medical, financial, or other professional services). You are solely responsible for how you use the outputs.

7. iCloud Sharing

When you explicitly choose to share via iCloud, shareable data is serialized to your iCloud to create a share link. We do not host or moderate such content and cannot remove it for you. You are responsible for content you share.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability relating to the app shall not exceed the total subscription fees (if any) you paid for the app in the twelve (12) months preceding the event giving rise to the claim.

9. Age Requirement

The app is not intended for children under 13. Minors must use the app under the supervision of a legal guardian, and only where permitted by law.

10. Export & Sanctions Compliance

You must comply with all applicable export control and sanctions laws and refrain from using the app in, or for the benefit of, restricted territories or persons.

11. Changes

We may update this TOU for functionality or compliance reasons. Material changes will be announced in‑app or on this page with an updated effective date.
